Working with over fifty of his House colleagues and Texas Senator Ted Cruz, Congressman Bill Posey has sent a letter to Attorney General Eric Holder demanding the appointment of an independent special prosecutor to investigate the IRS’s illegal targeting of conservative groups. Last year it was revealed that the IRS used inappropriate criteria to review organizations applying for tax-exempt status based upon their names and policy positions, released confidential donor information and even private taxpayer records.

“These are serious abuses and an independent special prosecutor is required to ensure that wrong-doers are held accountable and that public trust can be restored to the IRS,” said Congressman Posey. “It’s obvious from the various Congressional hearings and letters to the IRS that officials there were not telling Members of Congress the truth and deliberately hid the facts from the public about the targeting of certain groups.”

In their letter to Attorney General Holder, House Members state that:

On May 14, 2013, Treasury Inspector General for Tax Administration reported that the “IRS used inappropriate criteria that identified for review Tea Party and other organizations applying for tax-exempt status based upon their names or policy positions instead of indications of potential political campaign intervention.” We further learned that IRS employees illegally released donor lists of other conservative organizations.
 
To date, not a single IRS employee has been indicted for this offense. Ms. Lerner, who resigned from her position with the IRS, invoked her Fifth Amendment right against self-incrimination before the House Oversight and Government Reform Committee and refused to answer questions. The Wall Street Journal has further reported that the FBI does not plan to file any criminal charges.
